1. Acceptance of Terms

By accessing or using Roast by AI ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

2. Service Description

Roast by AI is an AI-powered website analysis service that provides:

• Automated website analysis across multiple categories (SEO, performance, accessibility, UX, etc.)
• AI-generated feedback and recommendations
• Scoring and tracking of website improvements over time
• API access for programmatic analysis (on eligible plans)

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Credits and Subscriptions

5.1 Credit System

Website analyses ("roasts") consume credits. Credits are allocated based on your subscription tier and do not roll over between billing periods unless otherwise specified. Credits have no cash value and cannot be transferred or refunded.

5.2 Subscriptions

Paid subscriptions are billed in advance on a recurring basis. You can cancel your subscription at any time, and you will continue to have access until the end of your current billing period. No refunds will be provided for partial billing periods.

5.3 Price Changes

We reserve the right to modify pricing at any time. Price changes will be communicated in advance and will take effect at the start of your next billing cycle.

6. API Usage

API access is available on eligible subscription tiers. By using our API, you agree to:

• Comply with the rate limits specified for your subscription tier
• Keep your API keys confidential and secure
• Not share or sell API access to third parties
• Not use the API to build a competing service
• Include appropriate attribution when required

7. Acceptable Use

You agree not to use the Service to:

• Analyze websites you do not own or have permission to analyze
• Submit URLs containing illegal, harmful, or malicious content
• Attempt to circumvent rate limits or abuse the Service
• Interfere with or disrupt the Service's infrastructure
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Harass, abuse, or harm other users
• Reverse engineer or attempt to extract the source code of the Service

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, content, and technology, is owned by Flatfish Software Solutions and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

8.2 Your Content

You retain ownership of the websites you submit for analysis. By using the Service, you grant us a limited license to access, analyze, and store your submitted URLs and their content solely for the purpose of providing the Service.

8.3 Analysis Results

You may use the analysis results generated by the Service for your own purposes. However, the underlying methodology and AI models remain our intellectual property.

10. Limitation of Liability

To the maximum extent permitted by law, Flatfish Software Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms shall limit or exclude our liability for: (a) fraud or fraudulent misrepresentation; (b) intentional misconduct or gross negligence; or (c) any other liability that cannot be limited or excluded under applicable law, including mandatory provisions of Dutch law.

11. Indemnification

You agree to indemnify and hold harmless Flatfish Software Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Abuse the Service or other users

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of The Netherlands.

15. Dispute Resolution

Before initiating any legal proceedings, you agree to first attempt to resolve any disputes informally by contacting us at hello@roastbyai.com. We will attempt to resolve the dispute within 30 days.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Flatfish Software Solutions regarding the Service and supersede any prior agreements.
